New York Unemployment: What should I do when I approach my BYE (Benefit Year Ending) date?

Many members are approaching one year since first filing for unemployment and are encountering problems in collecting additional unemployment benefits. Our Union brought these issues to the attention of New York State Department of Labor.

Do you need to file a new unemployment claim after 52 weeks?

If you have not worked OR you returned to work but have not earned 10 times your weekly benefit rate since filing your initial claim, you should continue to certify on your existing unemployment claim. As long as you received your first severance payment more than 30 days after your last day of work, severance pay will not count toward your earnings.

If you worked at any job and earned 10 times your weekly benefit rate since filing your initial claim, you must file a new unemployment claim. If you are still receiving severance bridge payments, your bridge payments should not affect your ability to collect unemployment as long as you received your first severance payment more than 30 days after your last day of work.

Not sure if you earned 10 times your weekly benefit rate? Your weekly benefit rate can be found in your “Payment History” in your online account with the DOL.
